BY-LAW 1
This organization shall be known as Local 000639, CFB Petawawa for the UNION OF NATIONAL DEFENCE
EMPLOYEES (UNDE) COMPONENT OF THE PUBLIC SERVICE ALLIANCE OF CANADA (PSAC), hereinafter referred to
as “THE LOCAL”.
BY-LAW 2 -INTERPRETATIONS
Section 1: The masculine gender used in these by-laws shall be construed to include the feminine,
and singular to include plural. “Local” shall mean “Local of the PSAC”.
Section 2: Component shall be “UNDE of the PSAC”.
Section 3:In cases of dispute or misunderstanding,the Executive will have final decision on
interpretation of these by-laws.
BY-LAW 3 -AIMS AND OBJECTIVES
Section 1: The Localshall subscribe to, and accept as its governing documents, the Constitution of
the PSAC and the by laws of the Component.
Section 2: The Local shall support fully the PSAC in the furthering of its constitutional
responsibility for the improvement and protection of wages, salaries and other terms of employment
of all employees.
Section 3: The seJVices provided by the Local shall be available, subject to the concurrence of the
LocalExecutive, to all members in good standing of the Local000639, UNDE and PSAC.
BY LAW 4-MEMBERSHIP
Section 1: The membership shall comprise those members of the PSAC who are employed by
GDIIntegrated Facmty Services at CFB Petawawa.
Section 2:Associate Membership (for benefit). Any former employee of the Local whose employment by
GDllntegrated Facility Services at CFB Petawawa is terminated by: reaching retirement age, medical
reasons, of abolition of position.
BY LAW 5- MEMBERSHIP DUES
Section 1: The membership dues of the Local shall be the amount of the per capita fees and dues
required by the Constitution of the PSAC and the by taws of UNDE and additional amounts as
determined by the Local.
Section 2: Membership dues shall be levied upon each and every member of the Local. These dues are
collected each month by PSAC and rebated to the Local in accordance with the UNDE Bylaw 5 Article
1. The current monthly dues rebate from PSAC to the Local shall be $5.00 per member of the Local.
Section 3: The Local may change Local membership dues by a 2/3 majority vote of those members
present and voting. The membership shall be notified by the Executive of such proposed increased
dues at least 30 days in advance of such meeting.
Section 4: Once said meeting is completed, the Local shall supply written documentation notifying
the Vice President of Ontario for furtherance to the Nation President.
Section 5:The Local shall notify UNDE Nation Office, through the Vice President of Ontario, to have
the Local rebate deducted and collected by the Union In the manner prescribed in UNDE Bylaw 5,
Article 2.
Section 6: The new Local rebate shall be sent by the Union to the Local as soon as administratively
possible following the date of notification being received in the Nation Office.
BY-LAW 6-LOCAL EXECUTIVE OFFICERS
Section 1: The officers of the Local shall consist of a President, a Vice President, a Secretary
Treasurer, and a Chief Shop Steward, all of whom shall be elected separately, in the order
mentioned, by members in attendance and voted at the regular meeting in November, where practical.
Where it is impractical to hold elections in November, they may be advanced or delayed for a period
not greater than one month in each case.
Section 2: All terms of office shall be for a two year period.
Section 3: Vacancies on the Executive of any elected officer of the Local (with the exception of
the President and Vice President, whose vacancies shalf be filled in accordance with By-Law 8,
Sections ( 4 and 5 ) shall be filled by giving a notice of motion of election at the next general
meeting though a simple majority vote. During the interim period, the Executive may provisionally
appoint a replacement.
Section 4: The elected officers shall be held accountable to the membership for all decisions of
the Local, and shalf have finalvote on all Executive decisions.
Section 5: The Past President may serve a term of one year on the Local Executive in an advisory
capacity if willing to actively participate and approved by a membership vote at the next regular
generalmeeting.
BY-LAW 7-ELECTION OF OFFICERS
Section 1:All officers shall be elected by secret ballot at a regular meeting in October, November
or December, in accordance with By-Law 6,Section 1.
Section 2:Only members in good standing shall have the right to vote at any election or at any
taking of ballots in connection with the Local.
Section 3:At a regular meeting, the Executive will appoint a Nominating Committee.
Section 4: Nominations may be submitted to the Nominating Committee at any time prior to the
regular meeting in October, November or December. The Chairperson of the Nominating Committee shall
report at the meeting all nominations received and shall call further nominations from the floor.
Section 5: A written nomination must be signed by two members in good standing and bear the signed
acceptance of the nominee.
BY-LAW 8-DUTIES OF THE LOCAL OFFICERS
Section 1:President. The President shall be responsible for the efficient and proper conduct of the
affairs of the Local. The President shall preside at all meetings of the Local, and at all meeting
of the Executive. The President shall supervise the work of other officers of the Local, and of all
committees, and perform such other duties as appertain to the office.
a. The President shall report on his activities to the Executive at each meeting, and to the
Localat each regular meeting, and to the Annual GeneralMeeting. The President shall be an
ex-officio member of all committees of the Local.
Section 2: Vice-President. The Vice president shall assist the President in the discharge of his
duties and shall perform such other duties as may be required of him by the President of the Local.
a. In the absence of the President, or in the event of his inability to act, the Vice
President shall assume his duties. Should the position of President become vacant, the Vice
President shall assume his duties for the remainder of the term.
b. Should the positions of President and Vice President become vacant, an election shall be
held at the next general membership meeting.
Section 3: Secretarv-Treasurer
a. The Secretary-Treasurer shall be responsible for all correspondence of the Local, both
incoming and outgoing, and shall ensure that all such correspondence is brought to the attention of
the Executive.. The Secretary-Treasurer shall keep minutes of the meetings and shall enter into
such minutes records of
financialmatters; and shall be responsible for the proper maintenance and distribution of the same;
b. The Secretary-Treasurer shall ensure that all monies received are deposited in a
chartered financial institution to the credit of the Local. He shall be responsible for the receipt
and disbursement of all monies otthe Local. The Secretary-Treasurer shall keep proper records
of all financial transaction of the Local. He shall be one of the two signing officers and shall be
responsible for all transactions in accordance with the requirement of said chartered financial
institution; and
c. On behalf of the Local, the Secretary-Treasurer shall submit, to the NationalOffice of
UNDE, and audited statement of the finances of the Local and a copy of the minutes of the meeting
at which it was approved, by December 31 of each year.
Section 4: Chief Shop Steward:
a. The Chief Shop Steward shall be responsible for the coordination and welfare of the
Local Shop Steward network;
b. The Chief Shop Steward shall be responsible for forwarding to the Union’s National Office,
all final level grievances, including all back-up information and shall be responsible for replying
to National Office inquiries on; any request for additional information on a finallevel grievance,
and any request for a specific report on a subject related to a final level grievance; and
c. The Chief Shop Steward shall report to the UNDE National Office on the number and
disposition of levelone and two grievances which have been resolved at the Local level.
d. The Chief Shop Steward shall preside at all Stewards meetings
Section 5:Local Shop Stewards:
The Steward shall be elected by members in good standing and/or appointed by the
Executive.
a. The Shop Steward shall be responsible for dealing with all initial membership workplace
complaints and grievances subject to the approval of the griever;
b. The Shop Steward shall report to the UNDE National Office on the number and disposition of
level one and two grievances which have been resolved at the Local level.
c. The Shop Steward shall be responsible for forwarding to the Union’s National Office, all
final levelgrievances, including all back-up information and shall be responsible for replying to
NationalOffice inquiries on; any request for additional information on a final level grievance, and
any request for a specific report on a subject related to a finallevel grievance; and
d. The Shop Steward shall attempt to participate in all Steward Meetings coordinated by the
Chief Steward;
e. The Shop Steward shall advice the Chief Steward of the Local of all grievances they are
presenting and provide the Chief Steward with a copy of the formal grievance fonn and all pertinent
documentation associated with same.
f. The Shop Steward shall be available to participate in Steward training;
BY-LAW 9-MEETINGS
Section 1:Regular meetings of the Local shall be held at least quarterly and shall be attended
by the Executive and members of the Local.
Section 2: Regular Executive Meetings of the Local shall be held, at least quarterly for the proper
conduct of the Local’s affairs.
Section 3: SpecialExecutive meetings shall be called by the President, upon written request of two
elected members of the Executive.
Section 4; Steward Meetings of the Local can be scheduled, organized and conducted at the
Regular Executive Meetings.
Section 5: Steward meetings will be held at least four (4) times per year. The purpose of these
meetings is to provide guidance and orientation to the Stewards of the Local.
Section 6: A special meeting may be called by the President, or upon written request of the
majority of the Executive of the Local, or upon written petition of i% 30% or more of the members
of the Local, and only the matter or matters for which the meeting was called shall be
discussed.The petition, request or notice shall include the business to be discussed.
Section 7: Only members in good standing of the Localmay participate at meetings of the Local or
its subordinate bodies, except that non-members may participate in an advisory capacity if
specifically requested to do so by the Chairperson or person in charge of the meeting.
Section 8: A quorum at an Executive meeting shall not be less then three of the elected officers.
Section 9: A quorum at a regular meeting, or special meeting, shall not be less then 5 members
of the Local
.Section 10: All meetings shall be conducted in accordance with the PSAC Rules of Order.
BY-LAW 10-FINANCES
Section 1:Funds of the Local,except for a petty cash fund, not to exceed $200, shall be held in
a chartered bank or savings institution, or in short term Government of Canada bonds, approved by
the Executive, in the name of the Local.
Section 2: Spending of the petty cash fund shall be accounted for to the membership at the next
regular meeting.
Section 3: A per diem at a rate of $25 per day shall be payable to all members participating in
training, conventions or administrative duties specifically for the Local.
Section 4: The officers authorized to sign cheques on the account of the Local are the President
and one of the following: Vice President or Secretary-Treasurer.
Section 5:An auditor’s review shall be done at any time the Secretary-Treasurer position is
vacated, prior to the accounts being turned over to the newly appointed/elected Secretary
Treasurer.
BY LAW 11- BY-LAWS
Section 1: A 2/3 majority vote of the members present and voting at the meeting shall be required
to pass the amendment, and if passed, it shalf be effective forthwith. These by-laws, or by-laws
amended,.remain in force on acceptance by the Local at a general membership
meeting or a special meeting called by the Executive for this purpose.
Section 2: A notice of motion of any amendment proposed to these by-taws must be given at a
regular meeting of the Local or at least 30 days prior to the date of the regular or special
meeting at which the proposed amendment is to be considered.
Section 3:The text of the proposed amendment must be included In the notice convening the meeting
at which the proposed amendment is to be considered.
BY-LAW 12-CONVENTION
Section 1: The LocalPresident, or his delegated elected officer, shall be the primary delegate to
all conventions to which the Local has delegate status. The remainder of the delegates to which the
Local shall be entitled for any convention, and a corresponding number of alternates, shall be
elected at a regular membership meeting.
Section 2: No person shall be entitled to attend a convention as a Localdelegate unless they have
attended 75% of all Localmeetings open to the generalmembership, held during the 12 month period
immediately prior to the month in which the delegates are selected.
